As part of the change in our distribution, the Software License and Service Agreement and Terms of Use will be transferred to Activision Blizzard UK Limited. Therefore, the Activision games you play and services you use (“Program”), digital content and services will no longer be provided by Activision Blizzard International B.V. after 31 December 2021. The same Program will be provided by Activision Blizzard UK Limited, meaning that your account, games’ level, achievements, rankings and history, as well as digital content and services will still be available and will remain the same. The change will take place on and from 1 January 2022, your relationship will be with Activision Blizzard UK Limited and the transferred Software License and Services Agreement and Terms of Use will apply from that date.
We will also update the Software License and Services Agreement to reflect:
- improvements to our anti-cheat system on PC, as recently announced. This is to enhance efforts toward fighting unfair play for players on PC that will also benefit console players competing via cross-play against players on PC.
- some language specifically for Australia and New Zealand players about their consumer rights.
If you are a player in LATAM, excluding Mexico:
Due to changes in how we distribute our games, we will be making changes to the Activision Blizzard entities that you will be contracting with as follows:
● For games played on computer (via the Battle.net gaming service) and Nintendo Switch the Software License and Service Agreement and Terms of Use will be transferred to Activision Publishing, Inc. Therefore, the Activision games you play and services you use (“Program”), digital content and services will no longer be provided by Activision Blizzard International B.V. after 31 December 2021. The same Program will be provided by Activision Publishing, Inc., meaning that your account, games’ level, achievements, rankings and history, as well as digital content and services will still be available and will remain the same. The change will take place on and from 1 January 2022, your relationship will be with Activision Publishing, Inc. and the transferred Software License and Services Agreement and Terms of Use will apply from that date.
● For games played on mobile devices, Sony Playstation, Microsoft Xbox and other third-party platforms, the Software License and Service Agreement and Terms of Use will be transferred to Activision Blizzard International LLC. Therefore, the Activision games you play and services you use (“Program”), digital content and services will no longer be provided by Activision Blizzard International B.V. after 31 December 2021. The same Program will be provided by Activision Blizzard International LLC, meaning that your account, games’ level, achievements, rankings and history, as well as digital content and services will still be available and will remain the same. - Addition of Section 3.G.: Consent to Monitor. WHILE RUNNING, THE PRODUCT (INCLUDING SOFTWARE, KERNEL LEVEL DRIVER, OR OTHER TECHNICAL MECHANISM) MAY MONITOR YOUR COMPUTER, OR CONSOLE FOR UNAUTHORIZED PROGRAMS OR PROCESSES RUNNING EITHER CONCURRENTLY WITH SOFTWARE OR OUT OF PROCESS. AN "UNAUTHORIZED PROGRAM" AS USED HEREIN SHALL BE DEFINED AS ANY SOFTWARE PROHIBITED BY SECTION 3.A. ABOVE. DURING THIS PROCESS CERTAIN IDENTIFYING INFORMATION ABOUT YOUR DEVICE, SOFTWARE, OR PROCESSES MAY BE COMMUNICATED BACK TO ACTIVISION TO ASSESS WHETHER ANY UNAUTHORIZED PROGRAMS ARE RUNNING. IN THE EVENT THAT THE PRODUCT DETECTS THE SIGNATURES OF UNAUTHORIZED ACTIVITY OR PROGRAMS, (a) THE PRODUCT MAY COMMUNICATE INFORMATION BACK TO ACTIVISION ABOUT THE UNAUTHORIZED ACTIVITY, INCLUDING WITHOUT LIMITATION YOUR ACCOUNT NAME, DETAILS ABOUT THE UNAUTHORIZED ACTIVITY DETECTED, AND THE TIME AND DATE; AND/OR (b) ACTIVISION MAY EXERCISE ANY OR ALL OF ITS RIGHTS UNDER THIS AGREEMENT, WITH OR WITHOUT PRIOR NOTICE TO THE USER. INFORMATION UNRELATED TO THE FOREGOING PROCESS FOR DETECTING UNAUTHORIZED PROGRAMS WILL NOT BE COMMUNICATED TO ACTIVISION AS PART OF THIS MONITORING. BY ACCEPTING THIS AGREEMENT, YOU ARE HEREBY AUTHORIZING ACTIVISION TO ACCESS YOUR DEVICE FOR THESE PURPOSES.
